1.0 Terms

AIAM Inc. and its affiliates (collectively “we”, “us”, “our” or “AIAM”), provides our internet site and the content, products and services offered on or through the site (collectively “Services” or “Trainings”) to you subject to the following Terms and Conditions of Use. By accessing or using our Services, you accept and agree to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site or accepting the Services. The materials contained in this web site are protected by applicable copyright and trade mark law.

Definitions:

1.1 Student: A person intending to enrol in an AIAM Training.

1.2 Training: AIAM Training.

1.3 Training duration: The duration of the Training, the dates of which shall be notified to the student by AIAM.

1.4 Fees: The tuition and all other expenses relating to the Training, payable by the Student to AIAM.

1.5 AIAM: The American Institute of Aesthetic Medicine

1.6 Online Payment Process: The process of enrolling and paying for a Training online through this website.

1.7 License Verification: The process of submitting proof of a valid USA medical license, state license when necessary.

2.0 Use License

Permission is granted to temporarily download one copy of the materials (information or software) on AIAM’s website for personal, non-commercial transitory viewing only, provided you keep intact all copyright and other proprietary notices. Use of the content or materials for any other purpose is prohibited. This is the grant of a limited revocable license, not a transfer of title, and under this limited license you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); rent, lease, loan, sell, distribute, broadcast or create derivative works based upon our content or software, attempt to decompile or reverse engineer any software contained on AIAM’s website; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or “mirror” the materials on any other server, in whole or in part.

This limited license shall automatically terminate if you violate any of these restrictions and may be terminated by AIAM at any time, with or without cause. Upon terminating your viewing of these materials or upon the termination of this limited license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

You acknowledge and agree that the Services and all contents and materials available on this site are protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws.

 3.0 The Contract

Shortly after booking a Training you will receive an e-mail or letter from us acknowledging that we have received and accepted your booking.

The acknowledgment of the contract will only occur when the final confirmation email is sent.

4.0 Fees and Payment

4.1 If you wish and you accept these Terms and Conditions, you (or a third party paying fees on your behalf) may pay the fees immediately on this website, by following the ‘Place Order’ link.

4.2 It is the Student’s responsibility to ensure that AIAM’s fees in respect of the Training (as stated on the website and in other Training publicity) and all other fees and expenses relating to the Training are paid at registration. AIAM reserves the right to refuse admission to any Student who has not paid all Fees in full before the Training starts.

4.3 Any information displayed during the Online Payment Process in regards to the registration fee from the Student is the final and complete Fee for the class.

4.4 All payments must be made in US dollars. Any currency conversion costs or other charges incurred in making the payment or in processing a refund shall be borne by the Student or the third party making payment and shall not be deductible from the fees due to AIAM.

5.0 Cancellations and refunds

All refunds are subject to incur a 3.5% processing fee on the total amount originally charged.

5.1 Cancellations made by you AT LEAST fourteen (14) calendar days before your Training date:

5.1.1 You have the right to cancel your enrolment to a Training at any time, as long as it is at least fourteen days before your Training date. You will receive a full refund of the price paid for the Training minus a 3.5% processing fee on the total.

5.1.2 If you choose to purchase and join a Training that is due to commence within 14 days of purchase, you will waive cancellation and refund rights in respect of the purchase.

5.1.3 Once the Training has taken place or been completed, you do not have a right to cancel or refund, even if you do not attend.

5.1.4 To cancel a contract please inform us by sending an email to hello@aiamtrainings.com.

5.1.5 Online trainings are not refundable.

5.2 Cancellations made by you within fourteen (14) calendar days of Course date:

5.2.1 If you cancel your enrolment in a Training at any time within fourteen days of the Training date, you will not be entitled to a refund, except in exceptional circumstances, at the discretion of the AIAM. In such circumstance that a refund is given an administration fee of 5% may be levied as well as the trainer’s travel and accommodation expenses.

5.2.2 In exceptional circumstances you may be able to transfer your enrolment to a different Training, or substitute a different Student onto the same Training, run by the AIAM, subject to a 5% administration fees. Training fees already paid can be transferred to the new Training, and any outstanding balance must be paid in full before the delegate can be registered in the new Training. No refund will be given if the cost of the new Training is less than the cost of the original Training.

5.2.3 To cancel a contract within fourteen days of your Training date or to transfer or substitute someone else, please inform us by email to the Training administrator or to hello@aiamtrainings.com explaining your reason for requesting the cancellation, details of the Training you are cancelling and your booking reference.

5.3 Training Cancellation by AIAM:

5.3.1 We will make all reasonable efforts to deliver the Training as outlined on the website and in any brochure. However, we reserve the right to:

  • Make reasonable adjustment to the timetable, location or presenters specified for a Training; and
  • Make reasonable amendments to the content and syllabus of a Training when necessary.

5.3.2 If the minimum of 3 registered attendees per Training has not been met up to 3 business days prior to any specific Training date we reserve the right to cancel that Training by giving you notice in writing. We will refund all registration fees paid by you and will endeavour to offer a transfer to another Training as an alternative, subject to payment or refund of any difference in purchase price. In no event shall you be entitled to a refund from AIAM for any flight or hotel booking fees charged to you as a result of us cancelling.

5.3.3 AIAM’s maximum liability will be limited to a refund of received fees for the cancelled Training. AIAM will not accept liability for any costs or losses incurred by Students or organizations which are claimed to have arisen through Training cancellation, other than for those stated here. You are strongly advised to take out insurance against cancellation of any Training if your travel costs are likely to be substantial.

6.0. Security

6.1 All payment details which are entered through this payment gateway are encrypted when the Student, or third party making payment, enters them. The site is secure and uses 256 encryption to offer secure communications by encrypting all data to and from the site.

6.2 AIAM shall not be liable for any failure by the Student or third party making payment of Fees to properly protect data from being seen on their screen by other persons or otherwise obtained by such other persons, during the Online Payment process or in respect of any omission to provide accurate information in the Training of the Online Payment Process.

7.0 Disclaimer of Warranties

The Services, including the materials on AIAM’s website, are provided “AS IS”. AIAM makes no warranties, express or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, AIAM does not warrant or make any representations concerning the accuracy, likely results, or reliability of the Services or the use of the materials on its website or otherwise relating to such Services or materials or on any sites linked to this site.

AIAM does not warrant that the Services or the functions on our site will be uninterrupted or error-free, that defects will be corrected, or that AIAM or the server that enables the Services to be available are free of viruses or other harmful components.

8.0 Limitations

In no event shall AIAM or its affiliates or suppliers be liable for any damages, including, without limitation, any special, incidental or consequential damages that are directly or indirectly related to Services, (including, without limitation, damages for loss of data or profits, or due to business interruption,) arising out of the Services or the use or inability to use the materials on AIAM’s website, even if AIAM or a AIAM authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

9.0 Visual and/or audio recordings

The organizers may take visual and/or audio recordings of Students during the Training and reserve the right to use these for promotional, management or educative purposes (in the United States or overseas). Students’ individual consent for this will be assumed to have been granted unless otherwise indicated by Students, in writing or by email, prior to the start of the Training.

10.0 Acceptable behaviour

In the interests of all Training participants, the organizers reserve the right to enforce the removal of any Student from the Training whose behaviour or demeanour is, in their view, considered unacceptable. If such occasion arises, student will not receive a refund for the Training.

11.0 Discount vouchers

Discounts for students attending AIAM Trainings are only valid for orders made the day of the Training. Other special promotions and discount offerings are at the discretion of the company the student wishes to purchase from.

12.0 Indemnification

You shall indemnify, defend and hold harmless AIAM and its affiliates and their officers, directors, employees and agents (collectively, the “Indemnified Parties”), from and against any and all claims, losses, damages, liabilities, judgments, liabilities and fees and expenses related thereto (including, without limitation, reasonable attorneys’ fees), incurred by an Indemnified Party in connection with any claims arising out of, based upon or resulting from any breach or violation by you of this Agreement or any use by you of the Services or this web site or as a result of a dispute with another user.

12.0 Variations to the Terms and Conditions

AIAM reserves the right to vary these Terms and Conditions from time to time and the current version will be published on this website. AIAM additionally reserves the right to amend Terms and Conditions without prior notifications.

13.0 Governing Law

Any claim relating to the Services and this web site shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions.

14.0 Feedback

Any questions, comments, suggestions, ideas, original or creative materials or other information you submit about AIAM or our Service or events (collectively, “Feedback”) is non-confidential and will become the sole property of AIAM.  We will own exclusive rights, including, without limitation, all intellectual property rights, in and to Feedback and will be entitled to the unrestricted use and dissemination of Feedback for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

15.0 Miscellaneous

These Terms constitute the entire agreement between you and AIAM relating to your access to and use of our Service. The failure of AIAM to exercise or enforce any right or provision of these Terms will not operate as a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect. Except as otherwise provided herein, these Terms are intended solely for the benefit of the parties and are not intended to confer third party beneficiary rights upon any other person or entity.

16.0 Severability

If any provision or part of a provision of these Terms is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.

WAIVER

I hereby agree and promise that I will not hold the AIAM, their employees, their agents, or others who are involved in supervision or operations of activities sponsored by Continuing Education responsible for any damages and/or personal injuries which I may receive as a result of participation in AIAM Education Trainings.
